Task Force on Citizens Claims Handling – Final Drafts of Proposed Legislation, Amendments and Summaries

During the recent series of Task Force on Citizen Claims Handling and Resolution (“Task Force”) meetings, Task Force members heard testimony from policyholders, public adjusters, attorneys, insurers and others involved in the claims dispute resolution process. 

Although the charge of the Task Force was focused on Citizens Property Insurance Corporation’s hurricane claims handling practices, it became apparent during the meetings that changes are needed in the current disputed claims resolution process.  For this reason, the members of the Task Force have proposed legislation to ensure that Public Adjusters are adequately trained, Appraisal Umpires are knowledgeable of the reconstruction process, and that the Appraisal Process is completed in a timely manner.

Below are links to the original draft of the proposed legislation for Public Adjusters which has been submitted to bill drafting, the amendments that were proposed following the November 16, 2007 workshop, and an updated summary.  

The original draft of the proposed legislation for Property Loss Insurance Appraisers has also been sent to bill drafting; however, following the workshop, the draft was amended to change the focus to the Appraisal Umpire and the Appraisal Process.
