Statement by Florida Insurance Commissioner Kevin McCarty on Allstate’s Emergency Motion for Immediate Relief

The Florida Office of Insurance Regulation (“OIR”) has issued the following statement by Florida Insurance Commissioner Kevin McCarty regarding an Emergency Motion for Immediate Relief filed by Allstate.

Commissioner Kevin McCarty’s Statement

TALLAHASSEE, Fla. – “My office has received Allstate’s Emergency Motion for Immediate Relief and is currently reviewing it very carefully.

“I stand behind the Order I issued Thursday suspending the Allstate companies from writing any new business in Florida until they have fully complied with the subpoenas my office sent them Oct. 16.

“This is just another step in the process that enables Allstate to further delay production of the documents we requested.

“Allstate’s motion is not unexpected, and it will not stymie my commitment to Florida’s consumers to get to the bottom of this issue.

“We are considering our legal options, and I will do everything within my authority as Florida’s insurance commissioner to ensure that the suspension remains in effect and that Allstate produces the documents requested by my office.

“We don’t know what action the First District Court of Appeals might take, but you can expect my office to take each and every action necessary to protect Florida consumers.”

Note: The suspension remains in effect unless the Court grants a stay.
