State Farm, Florida Office of Insurance Regulation Agree to Final Hearing on Withdrawal; Disagree on Date, Duration

In a Joint Response filed on July 15, 2009 with the Florida Division of Administrative Hearings (“DOAH”), State Farm Florida and the Florida Office of Insurance Regulation (“OIR”) agreed to a final hearing, but disagree on its timing and duration. The parties indicate that they are available for a hearing starting on October 12, 2009.
The July 15 Response follows a June 15 DOAH Order issuing a further stay of proceedings in an administrative appeal filed by State Farm as a result of the OIR’s conditional approval of its proposed Florida property insurance market withdrawal.
In the Response, State Farm Florida cites solvency concerns in support of its request for a final hearing date earlier than October 12, 2009.
However, the OIR disagrees on an earlier date suggested by State Farm, explaining that it anticipates “extensive discovery will be necessary,” and thus “any time prior to the beginning of November is probably an inadequate time to prepare.”
