Senate Sinkhole Bill Passes Second Committee

Senate Bill 742 Relating to Sinkhole Losses by the Senate Banking and Insurance Committee and Senator Mike Fasano (R-New Port Richey) unanimously passed the Senate Community Affairs Committee on March 10, 2009 with no amendments.  The bill now proceeds to the Senate General Governmental Appropriations Committee, its final committee of reference.

SB 742 would define the term “sinkhole loss prevention ordinance” and require the Florida Financial Services Commission to adopt a building code effectiveness grading schedule to evaluate the effectiveness of sinkhole loss prevention ordinances in reducing sinkhole claims frequency and severity.

SB 742 also would require insurance discounts and surcharges based on a property’s compliance with, and the grade assigned to, the applicable sinkhole loss prevention ordinance. 

If voted into law, the bill would become effective on January 1, 2010.
