Senate Passes Insurance Bills; Governor To Receive HB 535

The following insurance-related bills have been passed by the Florida Senate today and will proceed to the House for consideration:
SB 2174 Relating to Motor Vehicle Insurance/PIP revises the schedule of maximum charges on which an insurer may base a limited reimbursement for certain medical services, supplies, and care for injured persons covered by personal injury protection. Specifies a minimum amount for the applicable fee schedule or payment limitation under Medicare for such reimbursements.Â

SB 2462 Relating to Group Self-insurance Funds authorizes the board of trustees of certain self-insurers to declare any moneys in excess of the amount necessary to fund all obligations of the self-insurer as refundable to the members or policyholders of the self-insurer. Provides for the submission of certain information to the Florida Office of Insurance Regulation (“OIR”) if a self-insurer does not make or declare a dividend or member distribution payable during a given fund year.Â

SB 1012 Relating to Health Insurance Claims Payments authorizes the OIR to waive the requirement that each multiple-employer welfare arrangement maintain its principal place of business in this state if the arrangement meets certain specified conditions and has a minimum specified fund balance at the time of licensure. Provides requirements, limitations, and procedures for leasing, renting, or granting access to participating providers by third parties.Â

The following bill has passed previously in the House, therefore with today’s unamended Senate passage, it is ready to be signed by the Legislative Officers for presentation to the Governor.
HB 535 Relating to Health Insurance revises definition of “bone marrow transplant”; requires identification card containing specified information be given insureds under health benefit plans and group health insurance policies and persons having health care services through health maintenance contracts; provides for exception to specified identification card requirements for cards issued before specified date.
