SB 2338 Handwritten Amendment Clarifies PIP Medicare Fee Schedule

Despite efforts to defeat the amendment by the Florida Trial Lawyers Bar Association, Senator Dave Aronberg successfully amended Senate Bill 2338 relating to motor vehicle insurance in the Senate Commerce Committee meeting held today, April 15, 2008.

Senator Aronberg offered a handwritten amendment to his previous strike-all amendment in order to further clarify the Medicare fee schedule applicable to treatments made under personal injury protection (“PIP”) benefits.

The amendment inserts the following description of the fee schedule applicable to PIP benefits:

“200% of the allowable amount under the participating physician fee schedule of Medicare Part B”

We have attached a copy of the original amendment for your review; however please be advised that this amendment was subsequently amended in a handwritten form to reflect the statement above.

We will forward a copy of the handwritten amendment to SB 2338 upon receipt.
