OIR Hearing

Rule No: Rule Title 69O-125.005, .006Use of Credit Reports and Credit Scores by Insurers; Unfair Discrimination in Use of Credit Reports or Credit Scores by Insurers.
The Proposed Rules implement provisions of Florida statutes requiring the review and approval of an insurer’s use of credit reports and credit scores and also that requires submission of specified information and verification that the models, methods, programs and other processes are accurate predictors of risk and are in compliance with Florida law, which provides standards that ensure that rates or premiums associated with the use of a credit report or score are not unfairly discriminatory. The Rule specifies the statistical requirements and standards for the testing of credit scoring methodologies to assure they do not have a disproportionate impact on specified classifications.

The purpose of this regulation is to recognize, permit and prescribe the use of mortality tables that reflect differences in mortality between Preferred and Standard lives in determining minimum reserve liabilities in accordance with Florida Administrative Code.

The purpose of the hearing is to consider the actions needed to do the following: improve the oversight of the title industry and consumers ability to shop for title insurance; strengthen the regulation of affiliated business arrangements; and better protect Florida consumers by the publication of complete title insurance cost information, discounts, and retention data.

DATE AND TIME: Scheduled for August 14, 2007, has been changed to August 28, 2007, 9:00 a.m., at a regularly scheduled Cabinet meeting
PLACE: Cabinet Meeting Room, Lower Level, The Capitol, Tallahassee, Florida
This is the final public hearing on amendments to Rule 69O-167.015, F.S., adopting the Uniform Home Grading Scale.

 

Notice of Development of Rulemaking

The Florida Department of Revenue, Division of Child Support Enforcement has issued a Notice of Development of Rulemaking for Rule No: Rule Title: 12E-1.034: Insurance Claim Data Exchange
The Department is developing a Rule for a standard fee to be paid to an insurer or the insurer’s claim data collection organization for conducting a data match as provided by Section 409.25659, F.S.
The effect of this action is to ensure that the Department’s rules conform to the statute.  The subject area that will be addressed is the Department’s standard fee payable to an insurer or the insurer’s claim data collection organization that performs a data match to identify noncustodial parents who have a claim with the insurer and who owe past due support. The Department is accepting written comments or other material that might assist the Department to establish a standard fee.
If requested in writing and not deemed unnecessary by the agency head, a Rule Development Workshop will be noticed in the next available Florida Administrative Weekly.

 

Notices of Final Adopted Rule

A Notice Of Final Adopted Rule has been published for Rule No: Rule Title 69O-157.1155 Producer Training.  Insurers providing Long-Term Care insurance shall maintain records, subject to Office review upon request, that before any producer sells, solicits or negotiates a long-term care insurance policy, that they receive necessary and sufficient training to understand partnership policies and their relationship to public and private coverage for long-term care.

A Notice of Final Adopted Rule has been published for Rule No: Rule Title 19-8.030 Insurer Responsibilities.  The purpose of this Rule is to clearly establish certain deadlines and other requirements for insurers required to participate in the Florida Hurricane Catastrophe Fund (Fund or FHCF). It is not the intent or purpose of this rule to address every requirement of Participating Insurers which could result in a referral to the Florida Department of Financial Services.

A Notice of Final Adopted Rule has been issued for Rule No: Rule Title 69O-157.201 Standards For Approved Long-Term Care Partnership Program Policies relating to a policy or certificate, herein referred to as policy, marketed or represented to qualify as an approved long-term care partnership program policy as provided by Section 409.9102, F.S.,

A Notice of Final Adopted Rule has been issued for Rule No: Rule Title  69L-6.032 Contractor Requirements For Obtaining Evidence That Subcontractors Possess Workers’ Compensation Insurance or Otherwise Comply with Chapter 440, F.S.  In order for a contractor who is not securing the payment of compensation pursuant to Section 440.38(1)(a), F.S. to satisfy its obligation to obtain evidence of workers’ compensation insurance or a Certificate of Election to Be Exempt from a subcontractor pursuant to Section 440.10(1)(c), F.S.,  such contractor shall obtain and provide to the Department, certain evidence. 

A Notice of Final Adopted Rule has been issued for Rule No: Rule Title 19-8.010 Reimbursement Contract.  The reimbursement contract for the 1995-1996 contract year required by Section 215.555(4), F.S., which is called Form FHCF-1995K – Reimbursement Agreement between the insurer and The State Board of Administration of the State of Florida which Administers the Florida Hurricane Catastrophe Fund is hereby adopted and incorporated by reference into this Rule.
