The Louisiana Department of Insurance has issued a reminder to all property and casualty insurers licensed to write homeowners’ and fire and extended coverage insurance that all rate, rule and form revisions related to annual hurricane deductibles must be submitted to the Louisiana Department of Insurance by December 1, 2009 to ensure compliance with Act Number 134.

Implementation Of An Annual Hurricane Deductible Pursuant To Acts 2009, Number 134 of the Louisiana Legislature
Acts 2009, Number 134 of the Louisiana Legislature (codified as LSA-R.S. 22:1337), established provisions relative to the application of a hurricane deductible on an annual basis. Part B of the new legislation reads as follows:
“For all homeowners’ insurance policies or other policies insuring a one or two-family owner occupied premises for fire and allied lines, issued or renewed by authorized insurers on or after January 1, 2010, any separate deductible that applies in place of any other deductible to loss or damage resulting from a named storm or hurricane shall be applied on an annual basis to all named -storm or hurricane losses that are subject to the separate deductible during the calendar year.”
This notice serves as a reminder to all property and casualty insurers licensed to write Homeowners’ and Fire and Extended Coverage insurance in the state of Louisiana that all necessary rate, rule and form revisions must be submitted to the Louisiana Department of Insurance to ensure compliance with Act 134. The revisions must be submitted to the LDOI no later than December 1, 2009.
