Proposed Insurer Report Card Rule Withdrawn On Technicality; Rescheduling Expected

A Rule Hearing previously scheduled for January 4, 2010 on a mandated report card that would be used by the Office of the Florida Insurance Consumer Advocate in grading authorized Florida residential property insurers was withdrawn today, December 15, 2009.
However, the Florida Office of Insurance Regulation (“OIR”) has advised Colodny Fass that the Rule withdrawal is simply a procedural action because the Florida Department of Financial Services must promulgate the Rule, not the OIR, as was noted on previous notices on the proposed Rule and its attendant regulations.
It is expected that the hearing will be rescheduled. Further information will be provided as it becomes available.
