Proposed Aftermarket Auto Repair, Airbag Fraud Model Legislation to be Discussed During NCOIL Summer Meeting

A proposed Model Act relating to auto body damage claims and aftermarket parts and repair, along with proposed airbag fraud legislation will be among the issues scheduled to be discussed at the National Conference of Insurance Legislators (“NCOIL”) Summer Meeting from July 9-12, 2009 in Philadelphia. The proposed Auto Repair Model Act, a copy of which can be viewed by clicking here, would:
- Require disclosure and consent prior to crash part repair or replacement;
- Establish conditions for insurers to require the use of aftermarket crash parts, including provisions for new vehicles and those under original car-company warranty;
- Mandate permanent, transparent identification of crash parts; and
- Provide for consumer choice in the selection of an auto repair facility.
In addition to the airbag fraud proposal, other key model laws scheduled to be reviewed at the meeting include a credit default swap model that would regulate credit default swaps as insurance. Interested parties have submitted comments.
