Property Insurance Reform Legislative Meeting Feedback Outline

After holding the first of several anticipated meetings on July 30, 2009 regarding property insurance legislative reform, Florida House of Representatives and Senate staff have assembled a comprehensive outline of issues that were raised during the meeting. The outline, which focuses on ways to increase consumer choice and attract more private capital to the Florida insurance market, is attached.
Ideas that were considered in the meeting included addressing section 627.171, Florida Statutes (which is more commonly known as Florida’s excess rate or “consent-to-rate” statute) for the purpose of giving insurers greater flexibility in their ratemaking; expanding the role of the Florida Insurance Consumer Advocate or Public Counsel in insurance matters, flex-rating, tightening public adjuster laws and regulations; and addressing mitigation fraud and general insurance fraud.
Any legislative proposals resulting from these discussions are likely to focus on three guiding principles: consumer protection, consumer choice and the reduction or reform of insurance regulation.
