PIP, Tax-Related Special Session Bill Sent to Governor for Signature

Today, October 8, 2007, Governor Charlie Crist was presented with three bills passed during the 2007C Special Session.
The Governor must act on these bills by Monday, October 15, 5007. They are:
- HB 0001C Relating to Property Taxes by Representative Carlos Lopez-CanteraÂ
- HB 0013C Relating to Motor Vehicle Insurance Representative Ellyn BogdanoffÂ
- HB 0015C Relating to Pub. Rec./Motor Vehicle Insurance/DHSMV Representative Ellyn BogdanoffÂ

HB 0001C:Â General bill relating to Property Taxes: Changes time municipalities must have been in state of financial emergency to be considered municipality of special financial concern; provides for calculating maximum millage rates for 2008-2009 fiscal year for specified municipalities. Passed the House 105-0 and Senate by 37-0.Â
Effective Date: November 1, 2007.

HB 0013C:Â General bill relating to Motor Vehicle Insurance: Revives and re-enacts Florida Motor Vehicle No-Fault Law; revises property damage coverage requirements; revises PIP medical benefits; provides benefits for services & care ordered by physician or provided by certain others; requires benefits for certain providers to be reserved for specified period; authorizes reimbursement limits schedule for PIP benefits; prohibits billing or collecting in excess of certain limits; deletes provisions specifying allowable amounts for certain tests & services; extends period for paying overdue claim following demand letter; provides for penalties for failing to pay PIP claims; authorizes investigations and enforcement actions; requires certain related claims to be brought in one action; provides certain attorney fee limitations; authorizes electronic transmission of notices and communications under certain conditions; requires insurers continue to use certain forms and rates until specified date unless new ones approved; exempts purchaser of policy without PIP coverage from PIP requirement for specified period; requires insurer provide notice of coverage requirement or PIP endorsement. Passed House 105-4; Passed Senate 37-0
Effective Date: upon becoming a law.

HB 0015C:Â General bill relating to Public Rec./Motor Vehicle Insurance/DHSMV : Creates public records exemption for certain information regarding personal injury protection & property damage liability insurance policies held by DHSMV; authorizes conditional release of confidential & exempt information to specified persons; provides for retroactive application of exemption; provides for future review and repeal of exemption; provides statement of public necessity; provides contingent effective date. Passed House 107-0; Passed Senate 37-0 Nays.
Effective Date: on the same date that HB 13C or similar legislation takes effect, if such legislation is adopted in the same legislative session or an extension thereof and becomes law.
