Orders Issued By The OIR To Auto Insurers

We have been advised by the Office of Insurance Regulation (“OIR”) that it has issued Orders to 177 automobile insurance carriers in Florida. The affected carriers are those who made any rate, rule or form filings with the OIR in anticipation of the sunsetting of the former No-Fault Act. These Orders may have also been issued to certain carriers which made filings in anticipation of the sunsetting of the No-Fault Act, but subsequently withdrew those filings. The details of these Orders may vary; however, the purpose was for the OIR to emphasize the requirement of each of the affected automobile carriers’ responsibility to comply with the revived No-Fault Act which was recently enacted by the Florida Legislature, being careful to assure that the carriers do not rely upon any previously approved filings made in anticipation of the sunset of the prior No-Fault Act.

All affected carriers should carefully review the provisions of the revived No-Fault Act in order to assure compliance with that Act regardless of any filing which may have been approved by the OIR in anticipation of the sunset of the previous No-Fault Act.
