OIR Rule Hearings: My Safe Florida Home

Mar 18, 2008

The Florida Office of Insurance Regulation scheduled two Rule hearings for Tuesday, March 18, 2008 regarding My Safe Florida Home (“MSFH”). However, the hearings were not held because no interested parties requested them.

To access the meeting notice and full text of each Rule, click the Rule number below.

The first proposed Rule is 69J-7.004, entitled “Participating Contractors-Application and Participation Agreement.” The purpose of the Rule is to establish qualifications and certification requirements for mitigation contractors and provides for a process in which contractors agree to participate and homeowners select from a list of participating contractors. The Rule also incorporates a standard agreement form by which contractors may agree to participate.

The second proposed Rule is 69J-7.005, entitled “My Safe Florida Home Program, Forms for Use Regarding Grants.” The purpose of the proposed Rule is to adopt two forms for use by the MSFH in awarding grants to homeowners.

Florida Statutes provide that homeowners meeting certain criteria may be awarded grants by the Department of Financial Services (“DFS”) to fortify their home against hurricane wind damage. Both low-income and non-low-income persons may receive grants, but low-income applicants are in part subject to different requirements.

The Rule adopts two forms by which grants are awarded by the DFS to grant applicants. One form is for low-inclome homeowners, and the other form is for non-low-income homeowners. Each form is comprised of three standard documents sent together as a package to each homeowner awarded a grant.

The three documents that make up each form are:

  1. Cover letter awarding the grant
  2. A document stating the terms and conditions of the grant
  3. Reimbursement request documents to be used by the homeowner to obtain disbursement of grant funds when the improvements are completed
