Rule No: Rule Title: 69O-204.101  Disclosure to Viator of Disbursement

This proposed new Rule requires a viatical settlement provider to disclose to viators the gross amount it is paying for the insurance policy being viaticated, the net being paid to the viator, and a breakdown of all funds it is paying to other persons, such as viatical settlement brokers.

Financial Services Commission/Cabinet Meeting–Final Adoption of Rule

Rule No: Rule Title: 69O-171.002, .008  Reporting Requirements

Section 627.915(2) sets out a list of data property and casualty insurers must report on an annual basis to the Office by April 1 for the preceding year. The data is broken down by type of insurance. Current Rule 69O-171.002 sets forth the procedures which insurers must follow to comply with this duty. This Rule is being amended to adopt new technology in the collection of this data; the data being requested is exactly the same.
The Rule adopts two forms, the first an Excel spreadsheet upon which the data are entered, and the second instructions to assist the insurers in filling out the spreadsheet.

The Rule adopts the 2007 NAIC Quarterly and Annual Statement Instructions and NAIC’s Accounting Practices and Procedures Manual, as permitted by Section 624.424, F.S.

The Rule adopts the 2007 NAIC Financial Condition Examiners Handbook as permitted by Section 624.316, F.S.

This is the Final Public Hearing on the adoption of proposed amendments to Rule 69O-186.017, Florida Administrative Code, published on October, 12, 2007 in Vol. 33, No. 41, of the Florida Administrative Weekly, No notice of change was published.

Rule No: Rule Title:  69O-167.004  Required Preinsurance Inspection of Private Passenger Motor

Section 627.744 requires auto insurers which are insuring cars which have not been insured without interruption for the prior two years to perform a preinsurance inspection. The statute authorizes the Commission to adopt a form, by rule, for the purposes of this section. This amendment adopts a revision to the existing form to comply with changes in the statute.

This Rule is being amended to adopt forms to be used by the prepaid limited health service organizations in filing their quarterly and annual financial statements. The Rule is being updated to require the filings to be submitted on the National Association of Insurance Commissioners (NAIC) Health blanks
