NAIC Issues Draft Workers’ Compensation Coverage Guidelines For Comment by July 17

The National Association of Insurance Commissioners (“NAIC”) Professional Employer Organizations (“PEO”) Model Law Working Group has issued a draft Implementation Commentary entitled “Guidelines for Regulations and Legislation on Workers’ Compensation Coverage for Professional Employer Organization Arrangements.” Comments are requested no later than Friday, July 17, 2009, and may be sent to Bob Wake at Robert.A.Wake@maine.gov, with copy to Bob Card at bcard@naic.org.
The purpose of the Implementation Commentary is to assist states, PEOs and the insurance industry in implementing a regulatory framework consistent with the Guidelines for Regulations and Legislation on Workers’ Compensation Coverage for Professional Employer Organization Arrangements (“PEO Guidelines”) that were adopted by the NAIC in 2007.
The attached Implementation Commentary includes Appendix B for review and comment, as well as a complete copy of the PEO Guidelines for comparison.
