Louisiana Insurance Department: Some consent-to-rate filings may not be in compliance

In a review of recently-submitted consent-to-rate filings, the Louisiana Department of Insurance (“LDOI”) has determined  that some may not be in compliance with the State’s insurance code. 

In a bulletin issued on December 1, 2009, Louisiana Insurance Commissioner Jim Donelon reminds insurers that, if it is determined by the LDOI that an incorrect filing method has been used, the proposed rate filing will be disapproved. 

Insurers are being asked to review Louisiana regulatory guidelines applicable to consent-to-rate filings, A-rated filings and individual risk-related filings.  Commissioner Donelon states that “In submitting these rate filings to the LDOI, it is imperative that insurers indicate which of the three filing methods is applicable.”
