Louisiana Department of Insurance Issues Guidance on Certificates of Insurance Pursuant to Legislative Change

The Louisiana Department of Insurance  (“LDI”) has advised that ACT 1017 (HB 447) of the 2010 Louisiana Regular Legislative Session amends and enacts LSA R.S. 22:881.1, which has been recodified as LSA R.S. 22:890 relative to certificates of insurance is effective January 1, 2011. 

All certificates of insurance, no matter how titled, that are issued to a third person not a party to the subject insurance contract as evidence of property and casualty insurance coverage, must be filed and approved with Louisiana’s Commissioner of Insurance.   Please note that this includes certificate of insurance forms developed to satisfy governmental agency rules, such as SR-22 forms.

Certificates of insurance approved prior to the issuance of LDI Regulation 99, except those certificates approved by statute, must be revised to include a LDI number and approval date.
