OIR Rule Hearing
The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”), has issued a Notice of Development of Rulemaking regarding the following Rules:
- 69O-125.005: Use of Credit Reports and Credit Scores by Insurers
- 69O-125.006: Unfair Discrimination in Use of Credit Reports or Credit Scores by Insurers
The proposed Rules would implement the provisions in Florida law addressing compliance, statistical detail and the standards necessary to ensure that rates or premiums associated with credit reports or scores are not unfairly discriminatory. The proposed Rules also would address standards for the review of models, methods, programs, or other processes that produce credit scores to determine that they are not unfairly discriminatory.

The Florida Department of Financial Services, Office of Insurance Regulation, has issued a Notice of Proposed Rule regarding the following Rules:
- 69O-204.010: Purpose and Scope
- 69O-204.020: Definitions
- 69O-204.030: Forms Incorporated By Reference
- 69O-204.040: Prohibited Practices
- 69O-204.050: Verification of Coverage
The purpose of the proposed Rules are to give the Financial Service Commission the authority to adopt Rules to administer the Viatical Settlement Act.

The Florida Department of Financial Services, Office of Insurance Regulation, has issued a Notice of Proposed Rule regarding the following Rule:
- 69O-175.008: Unfair Discrimination in Private Passenger Motor Vehicle Insurance Rates – Based on History of Accidents
The purpose of the proposed Rule is to clarify that imposing additional premium on an existing or new insured based upon non-fault accidents is a violation of Florida law.
