The proposed Rule amendments address electronic proof of coverage filing requirements for employee leasing companies that are reporting claims EDI filings to the Florida Division of Workers’ Compensation. The proposed Rule amendments also address revisions made to forms and the EDI Implementation Manual.

The purpose of the proposed Rule amendments is to incorporate changes to the Florida Title XIX Long-Term Care Reimbursement Plan payment methodology, which became effective July 1, 2008. The proposed amendments would clarify the interim rate provision as it pertains to general and professional liability insurance.

- 69O-175.008: Unfair Discrimination in Private Passenger Motor Vehicle Insurance Rates – Based on History of Accidents
The purpose of the proposed Rule is to clarify that imposing additional premium on an existing or new insured based upon non-fault accidents is a violation of Florida law.

Florida Division of Workers’ Compensation: Three-Member Panel
The Florida Division of Workers’ Compensation has scheduled a meeting of the Three-Member Panel to consider comments and testimony regarding the proposed adoption of Medicare’s Outpatient Prospective Payment System. This system, in concert with determined payment adjustment factors, would serve as the methodology for reimbursing hospitals 60 and 75 percent of usual and customary charges for outpatient services provided to Florida’s injured workers. The proposed reimbursement methodology would amend Rule 69L-7.501.
Additionally, the Three-Member Panel will provide guidance for development of the 2009 Biennial Report to the President of the Florida Senate and Speaker of the House of Representatives. To view a copy of the meeting Notice, click here.

Workers’ Compensation Rule Hearing
The Florida Department of Financial Services, Division of Workers’ Compensation, has issued a Notice of Proposed Rule regarding the following Rules:
- 69L-7.020: Florida Workers’ Compensation Health Care Provider Reimbursement Manual
The purpose of the proposed Rule is to:
- Address proposed revisions to the Florida Workers’ Compensation Health Care Provider Reimbursement Manual, 2008 Edition
- Implement the 2008 conversion factors issued by the Centers for Medicare and Medicaid Services
- Provide guidelines detailing the circumstances under which providers may collect co-payments from claimants
- Provide new language recognizing the National Correct Coding Initiative Edits as an appropriate resource for insurer use in the bill review process
- Provide that a health care provider may not petition to resolve a reimbursement dispute when services were rendered pursuant to an authorized workers’ compensation managed care arrangement
