The proposed changes would:

Amend the Rule Chapter to incorporate by reference revised forms, instructions, manuals and implementation guides for use by insurers in the electronic reporting of proof of coverage and claims information to the Division of Workers’ Compensation
Add a Rule specifying insurer reporting proof of coverage requirements for a professional employer organization or employee leasing company and its client companies
Add a definition for “Cancellation/Non-Renewal Date”
Delete redundant language
Change the Rule Chapter title
Concurrently upon adoption of the proposed amendments, repeal Rule 69L-56.330, which has become obsolete

Workers’ Compensation Rule Hearing

The Florida Department of Financial Services, Division of Workers’ Compensation has issued a Notice of Proposed Rule regarding the following Rule:

69L-6.028: Procedures for Imputing Payroll and Penalty Calculations

The purpose of the proposed Rule amendment is to provide the Department of Financial Services alternative means and methods by which it may calculate an employer’s imputed payroll and penalty, to clarify the timeframe within which such imputation may occur, and to define the meaning of “non-compliance” within the Rule.

Additionally, the proposed Rule amendment would delete language regarding penalty assessments for periods of noncompliance that occurred prior to October 1, 2003.

OIR Rate Hearing

The Florida Department of Financial Services, Office of Insurance Regulation has issued a Notice of Workshop Hearing regarding rate increases requested by State Farm Florida Insurance Company.

State Farm Florida has requested average statewide rate increases of 53.7 percent, 97.3 percent, 70.8 percent, and 89.1 percent for its mobile homeowners, rental condominium unit owners, apartment and rental dwelling programs, respectively.

The proposed rate increase for mobile homeowners would be effective April 1, 2009 for new business and July 1, 2009 for renewal business. Proposed rate increases for the other programs would be effective February 1, 2009 for new business and April 1, 2009 for renewal business.

The purpose of the hearing is to receive input from the insurers and interested parties.
