NCCI Workers’ Compensation Rate Hearing

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”), has issued a Notice of Workshop Hearing regarding the workers’ compensation rate filing made by the National Council on Compensation Insurance, Inc. (“NCCI”).

In its filing, the NCCI requested an overall average decrease in workers’ compensation rate levels of 14.1 percent for all new and renewal policies written in the State of Florida’s voluntary market effective January 1, 2009.

OIR Rule Development Workshop

The Florida Department of Financial Services, Office of Insurance Regulation, has issued a Notice of Development of Rulemaking regarding the following Rule:

The purpose of the proposed Rule is to provide the required training standards for insurance agents who sell long term care insurance. This Rule outlines training standards which are consistent with the NAIC’s recommended standards.

Florida Division of Workers’ Compensation Rule Hearing

The Florida Department of Financial Services, Division of Workers’ Compensation, has issued a Notice of Proposed Rule regarding the following Rule:

The purpose of the proposed Rule is to revise the following forms to comply with the Florida law precluding an agency from requesting an individual’s social security number unless such collection conforms to the specified provisions of that statute. The proposed Rule would revise the following forms:

  • Form DWC 250 (Notice of Election to be Exempt), would be amended to include a purpose and use statement regarding the collection of the social security number
  • Forms DWC 250-R (Notice of Revocation of Election to be Exempt), DWC 251 (Notice of Election of Coverage), and DWC 251-R (Revocation of Election of Coverage), would be amended so that collection of the social security number is discontinued

The proposed Rule amendment also would revise the existing field office address.

OIR Rate Hearing

The Florida Department of Financial Services, Office of Insurance Regulation, has issued a Notice of Workshop Hearing regarding rate increases requested by Cincinnati Insurance Company and Cincinnati Indemnity Company.

Cincinnati Insurance Company and Cincinnati Indemnity Company have requested average statewide rate increases of 36.8 and 39.6 percent for their homeowners and dwelling fire programs, respectively. The proposed rate increases would be effective March 1, 2009, for new and renewal business. The requested rate increases are not uniform and some areas are subject to higher rate increases.

The purpose of the hearing is to receive input from the insurers and interested parties.

Citizens Property Insurance Corporation (“Citizens”) Mission Review Task Force Meeting

The first meeting of the Citizens Mission Review Task Force has been scheduled to take place on Friday, October 10 at 10:00 a.m. at the Tampa Airport Marriott and via teleconference. The call-in number is: 866.855.4989; conference code: 65685844.

The Citizens Mission Review Task Force was created to analyze and compile available data and to develop a report setting forth the statutory and operational changes needed to return Citizens to its former role as a state-created, noncompetitive residual market mechanism that provides property insurance coverage to risks that are otherwise entitled but unable to obtain such coverage in the private insurance market.

The Florida Department of Revenue, Miscellaneous Tax Division, has issued a Notice of Development of Rulemaking regarding the following Rule:

The purpose of the proposed amendments to Rule 12B-8.016, is to update the method of computation used to determine which portion of the Florida Insurance Guaranty Association Assessment should be included on the Florida side of the retaliatory tax computation.

The National Council on Compensation Insurance, Inc. will hold an Appeals Board meeting on Tuesday, October 14 from 9:00 a.m. through 3:00 p.m. at the Hyatt Regency Orlando International Airport, 9300 Airport Boulevard, Orlando, Florida.

The purpose of the meeting is to provide a mechanism by which aggrieved parties may obtain a review of the workers’ compensation rules applied to their individual policies.

FHCF Advisory Council Meeting

  • Forms DFS-F2-DWC-1a (Wage Statement) and DFS-F2-DWC-30 (Authorization and Request for Unemployment Compensation Information) would be revised so that collection of a social security number is discontinued
  • Forms DFS-F2-DWC-1 (First Report of Injury or Illness), DFS-F2-DWC-3 (Request for Wage Loss/Temporary Partial Benefits), DFS-F2-DWC-4 (Notice of Action/Change), DFS-F2-DWC-12 (Notice of Denial), DFS-F2-DWC-13 (Claim Cost Report), DFS-F2-DWC-14 (Request for Social Security Disability Benefit Information), DFS-F2-DWC-19 (Employee Earnings Report), DFS-F2-DWC-33 (Permanent Total Off-Set Worksheet), DFS-F2-DWC-35 (Permanent Total Supplemental Worksheet), DFS-F2-DWC-40 (Statement of Quarterly Earnings for Supplemental Income Benefits), and DFS-F2-DWC-49 (Aggregate Claims Administration Change Report) would be revised to include a purpose and use statement regarding collection of the social security number

Clerical revisions also would be made to existing Rules in this Chapter to maintain consistency.
