Workers’ Compensation Rule Development Workshop
The Florida Department of Financial Services, Division of Workers’ Compensation, has issued a Notice of Development of Rulemaking regarding the following Rules:
- 6L-10.006: Definitions
- 6L-10.012: Review of Proof of Claim
- 6L-10.015: Deemed Denial – 120-Day Time Period
- 6L-10.016: Documenting Expenditures for Purposes of Obtaining Reimbursement
- 6L-10.017: Reimbursement to Subsequent Employer
- 6L-10.019: Forms
The purpose of the proposed Rules is to revise forms to comply with Florida law precluding an agency from collecting an individual’s social security number unless such collection conforms to specified provisions of that statute. In lieu of social security numbers, the revised forms shall utilize an “SDTF Claim Number” for purposes of identifying and tracking claims.
The following forms would be amended:
- SDF-1 (Proof of Claim)
- SDF-2 (Reimbursement Request)
- SDF-6 (Explanation of Benefits)
Rule 69L-10.017, and form SDF-5 (Claim for Reimbursement for Salary) also would be deleted, as there is no statutory authority for the reimbursements prescribed in either.

The Florida Department of Financial Services, Office of Insurance Regulation, has issued a Notice of Proposed Rule regarding the following Rule:
- 69O-164.040: Determining Reserve Liabilities for Pre-need Life Insurance
The purpose of the proposed Rule is to recognize the inadequacy of the 2001 Commissioners Standard Ordinary Life Valuation Mortality Table for use in determining the minimum standard of valuation and the minimum standard nonforfeiture value, and to require continued use of the 1980 Commissioners Standard Ordinary Life Valuation Mortality Table.

Workers’ Compensation Rule Development Workshop
The Florida Department of Financial Services, Division of Workers’ Compensation, has issued a Notice of Development of Rulemaking regarding the following Rules:
- 69L-6.028: Procedures for Imputing Payroll and Penalty Calculations
The purpose of the proposed Rule amendments is to provide alternative means and methods by which an employer’s imputed payroll and penalty may be calculated, to clarify the timeframe within which such implementation may occur, and to define the meaning of “non-compliance” within the meaning of the Rule. Additionally, the proposed Rule amendments would delete language regarding penalty assessments for periods of noncompliance that occurred prior to October 1, 2003.

- 59G-6.010: Payment Methodology for Nursing Home Services
The purpose of the proposed Rule amendments is to incorporate changes to the Florida Title XIX Long-Term Care Reimbursement Plan payment methodology, which became effective July 1, 2008. The proposed amendments would clarify the interim rate provision as it pertains to general and professional liability insurance.

The purpose of the proposed Rule is to clarify that imposing additional premium on an existing or new insured based upon non-fault accidents is a violation of Florida law.

- 69L-7.020: Florida Workers’ Compensation Health Care Provider Reimbursement Manual
The purpose of the proposed Rule is to:
- Address proposed revisions to the Florida Workers’ Compensation Health Care Provider Reimbursement Manual, 2008 Edition
- Implement the 2008 conversion factors issued by the Centers for Medicare and Medicaid Services
- Provide guidelines detailing the circumstances under which providers may collect co-payments from claimants
- Provide new language recognizing the National Correct Coding Initiative Edits as an appropriate resource for insurer use in the bill review process
- Provide that a health care provider may not petition to resolve a reimbursement dispute when services were rendered pursuant to an authorized workers’ compensation managed care arrangement

- 69O-137.001: Annual and Quarterly Reporting Requirements (Notice)
- 69O-138.001: NAIC Financial Condition Examiners Handbook Adopted (Notice)
The purpose of the proposed amendments to Rule 69O-137.001 is to adopt the 2008 NAIC manuals for annual and quarterly statements and accounting practices and procedures, which are the latest versions. The current Rule adopted the 2007 versions.
The purposed of the proposed amendments to Rule 69O-138.001 is to adopt the 2008 NAIC Financial Condition Examiners Handbook, which is the latest version. The current Rule adopted the 2007 version.
