Insurance Capital Build-Up Incentive Program, Health Insurance, Workers’ Compensation Bills Sent to Governor

Governor Charlie Crist was presented with the following insurance-related bills on May 30, 2008:

  • CS/HB 5057: Relating to the Insurance Capital Build-Up Incentive Program

The relevant provisions of HB 5057 were incorporated into SB 2860, with the exception that HB 5057 requires insurers to commit to writing 10 percent of new premium for policies taken out of Citizens Property Insurance Corporation (“Citizens”) whereas SB 2860 requires a 15 percent premium commitment for policies taken out of Citizens.

SB 2860 contains a supremacy clause that provides for it to supersede and control HB 5057.  Accordingly, since SB 2860 was recently signed by the Governor, with the exception of the appropriation language contained in it, SB 2860 controls over the provisions of this Bill.

  • HB 461: Relating to Health Flex Plans
  • CS/HB 535: Relating to Health Insurance
  • HB 5043 Relating to Surplus Lines Tax
  • HB 5045: Relating to Workers’ Compensation Medical Services and Supplies

The Governor has until June 14, 2008, to sign, veto, or allow these bills to become law without his signature.
