COMMISSIONER APPROVES EMERGENCY ORDER FOR PRESCRIPTION REFILLS

Tallahassee Florida Insurance Commissioner Kevin McCarty approved an emergency order to suspend the operation of certain statutes governing the provision of prescription refills. The emergency order affects all health insurers, HMOs, and other entities regulated by the Office of Insurance Regulation (“Office”). The order can be found on the Office of Insurance Regulations (Office) website at: http://www.floir.com.

This emergency order will assist Floridians affected by Tropical Storm/Hurricane Alberto to obtain prescription refills. The order temporarily removes restrictions that refills must be given in 30-day batches, and instead allows health providers to fill prescriptions through July 31, 2006. The Commissioner determined that Tropical Storm Alberto posed an immediate threat to the public health.

Yesterday, Governor Jeb Bush issued Executive Order Number 06-130 following reports from the National Hurricane Center that Tropical Storm Alberto had strengthened in the Gulf of Mexico, and is making landfall in the Florida Panhandle.
