Help us Oppose Language that Would Eliminate the

Mar 6, 2014

We represent the Florida Auto Dismantlers & Recyclers Association (FADRA) and would like to request permission to use your name in opposing any legislation that would eliminate the”80 percent” damage threshold now in place and replace that objective standard with a subjective narrative that would allow for severely damaged vehicles to be rebuilt.  This proposed change will put Floridians and others at great risk from the increased number of unsafe vehicles this proposed language change would put back on the road.  In addition, this proposal will shrink the pool of available used parts.  We urge your support to make sure we maintain the 80 percent damage rule.

The current 80 percent threshold requiring a damaged vehicle to be totaled as “unrebuildable” is a standard measure that has served Florida citizens well.  To remove this accepted standard that has been in law for 25 years will endanger Floridians across the state.  Branding unsafe vehicles with a “repairable” designation can only end in deceived consumers, hidden flaws and repeated tragedy on Florida roads.

Not only would this change be an extreme health and safety risk for Floridians, it will lower the amount of salvage vehicles available for parts which could result in higher prices for used parts.   It could also cause a shortage of ferrous and non-ferrous metals which will result in higher prices for scrap metal.

Again, we ask that you give us permission to use your name to oppose legislation that would strike the certificate of destruction requirement and replace that standard with a subjective narrative.  Please reply to Cody Schwarz (cschwarz@cftlaw.com) and let us know we have your support.
