Health Insurance Exchange Proposed Rule Comment Period is 75 Days; Reinsurance, Risk Corridors and Risk Adjustment To Be Considered

Public comment will be taken for 75 days subsequent to the U.S. Department of Health and Human Services’ (“HHS”) July 11, 2011 announcement of proposed regulations for state oversight of Health Insurance Exchanges (“Exchanges”) under the Patient Protection and Affordable Care Act.
In drafting these proposals, the HHS examined Exchange models, held numerous stakeholder meetings and consulted closely with state leaders, consumer advocates, employers and insurers. To continue that conversation, the HHS is accepting public comment on the proposed Rules over the next 75 days to learn from states, consumers, and other stakeholders how the Rules can be improved. HHS will modify these proposals based on feedback it receives.
The first proposed Rule outlines a framework that will enable States to build Exchanges. To view this document, click here.

To facilitate that public comment process, HHS will convene a series of regional “listening sessions” and meetings. Schedules have not yet been released.
