Genetic Testing, Prohibition Against Genetic Information Use August 25 Rule Hearing Canceled

An August 25, 2009 Hearing scheduled by the Florida Office of Insurance Regulation regarding proposed Rule 69O-156.020, entitled “Prohibition Against Use of Genetic Information and Requests for Genetic Testing” was not held because it was not requested by any member of the public.  To view the Hearing notice, click here.

The proposed Rule would allow for a new product generation by adopting further revisions to the National Association of Insurance Commissioners’ (“NAIC”) Model Regulation to Implement the NAIC Medicare Supplement Insurance Minimum Standards Model Act.  This regulation includes major changes to Medicare Supplement plans and benefits that were first approved by the NAIC in March 2007 and authorized by the Medicare Improvements for Patients and Providers Act of 2008 (“MIPPA”).

The proposed Rule would adopt the NAIC model revisions that contain certain changes required by the Genetic Information Nondiscrimination Act of 2008 (“GINA”).
