FWCJUA Operations Committee Meeting Report: December 1

On Monday, December 1, 2008, the Florida Workers’ Compensation Joint Underwriting Association (“FWCJUA”) held an Operations Committee (“Committee”) meeting.  To view the complete meeting agenda, click here.  Items discussed included:

Legislative Update

FWCJUA General Counsel Tom Maida updated the Committee on workers’ compensation issues that have arisen due to the recent Supreme Court ruling in the case of Emma Murray vs. Mariner Health, Inc. and ACE USA (“Emma Murray”).  As a result of the ruling, the National Council on Compensation Insurance (“NCCI”) filed an amended rate request with the Florida Office of Insurance Regulation (“OIR”) on November 14.  The OIR has scheduled a public hearing on the NCCI rate filing for December 16. 

According to Mr. Maida, the full impact of the Emma Murray decision on the workers’ compensation market is unknown.  He stated that the current issue is whether legislators will make any changes to the Rules governing attorney’s fees during the upcoming 2009 Legislative Session. 

Proposed 2009 Business Plan and Forecast

FWCJUA Executive Director Laura Torrence reviewed the proposed 2009 Business Plan, which incorporates all changes requested by the Board of Governors.  During the review, Committee members offered suggestions on eco-friendly office programs.

FWCJUA Staff member Laura Lopez presented the 2009 Business Forecast.  Ms. Lopez cautioned that the numbers presented in the Forecast are not final, but represent the most up-to-date figures.  Forecast figures will be finalized on December 31.

The Committee approved the 2009 Business Plan and Forecast.

Disaster Recovery Matters

Ms. Torrence briefly discussed revisions to the Disaster Recovery and Emergency Preparedness Plan.  Changes include an update to the Table of Contents to incorporate a new form, and editorial revisions.  Committee members adopted Ms. Torrence’s revisions. 

Service Provider Audit Report

Ms. Torrence presented the Service Provider Audit Report (“Report”).  The Report comprises results of the performance audit conducted by the FWCJUA of Travelers, FWCJUA’s policy administrator and managed care service provider.

FWCJUA Staff performed the audit In July, 2008, which resulted in a cumulative score of 96.3 percent and an overall “commendable” rating.  No Committee action was requested.
