FPCA UPDATE: Medicare, Medicaid and SCHIP Extension Act of 2007

UPDATE: The Centers for Medicare & Medicaid Services (“CMMS”), a division of the U.S. Department of Health, has set up a dedicated Web site (http://www.cms.hhs.gov/MandatoryInsRep) for information regarding S.2499, the Medicare, Medicaid and SCHIP Extension Act of 2007 (“SCHIP”).
CMMS also has created an opt-in e-mail notification system designed to provide updates on Section 111 of SCHIP. To register, click “For e-mail updates and notifications” at http://www.cms.hhs.gov/MandatoryInsRep.
Section 111 of SCHIP amends the Medicare Secondary Payer provisions of the Social Security Act to provide for mandatory reporting for group health plan arrangements, liability insurance (including self-insurance), no-fault insurance, and workers’ compensation. The first public announcement regarding the Section 111 program and its requirements is expected within the next month.
The effective date of SCHIP is January 1, 2009.
SCHIP, the State Children’s Health Insurance Program, is Title XXI of the Social Security Act and is jointly financed by the federal and state governments and administered by the states. Within broad federal guidelines, each state determines the design of its program, eligibility groups, benefit packages, payment levels for coverage, and administrative and operating procedures.
