FPCA Member Feedback Requested: Loss Assessment Amendments Filed to Condo Bill
Apr 23, 2009
Among the amendments she has filed to House Bill 419, State Representative Ellyn Bogdanoff has filed two others relating to loss assessment insurance coverage. HB 419, along with these two amendments, has been on the House Calendar since April 3.
Florida Property Casualty Association member feedback is requested on these amendments, copies of which are attached.
HB 419 repeals a 2008 law requiring condominium unit owners to purchase individual unit coverage, repeals owners’ duty to name their association as an additional insured, repeals the requirement that condominium associations request from unit owners evidence of a currently effective insurance policy, and repeals the related enforcement mechanisms. The bill also clarifies that coverage under a condominium unit owner’s policy is excess coverage.
