Attached is an agenda for the meeting, as well as minutes from the November 16, 2011 meeting.
Also attached is the Proposed Petition for Rule Challenge regarding the letter to neutral evaluators. Please note that the FPCA is not arguing in the Petition that the structural damage definition should be applied retroactively. Rather, it argues that the definition is a clarification as stated by the Legislature and that the Department of Financial Services is not free to disregard the Legislature’s mandate when developing guidelines for the evaluators.
