FPCA Automobile Division: Special Report on PIP

Dear FPCA Automobile Division Members:
I had a conversation today with David Simmons, the new Senate Banking & Insurance Committee Chair. Senator Simmons indicated that due to the redundancy with the Patient Protection and Affordable Care Act (“PPACA”), he has an interest in thoroughly analyzing proposals that would allow PIP to sunset after PPACA has been fully implemented in a couple of years. His position is that since PIP benefits are primary, it puts Floridians in a position where they are subsidizing the cost of PPACA for the rest of the country. Senator Simmons acknowledged a sunset of PIP would be unpopular with hospitals and the medical community.
During the conversation, Senator Simmons mentioned that he has had several conversations with the Senate President on ideas for this legislative session. Although he did not specifically reference the Senate President in the conversation about PIP, it is possible the topic was discussed.
