FPCA Auto Division: Should the Florida Property and Casualty Association Join Trial Lawyers in Support of PIP Sunset?

Florida Property and Casualty Association Auto Division Members:

It has come to our attention that some of you have received information that legislation has been filed that would sunset Florida’s Personal Injury Protection (“PIP”) laws. 

This is not true.

The sponsors of the PIP reform legislation are very upset that the bills failed and have informally discussed trying to implement another sunset, but no amendment has actually been filed, nor has any amendment been approved for filing by legislative leadership.

At this point, the issue appears to be simply discussion.  As you all know, the Trial Lawyers have historically been very supportive of a PIP repeal and we believe they see an opportunity to obtain support for another PIP sunset.

We need to hear from you on whether the FPCA should join forces with the Trial Lawyers in this effort.  Please send your comments to Katie Webb (kwebb@cftlaw.com) at Colodny Fass.

Additionally, we expect an amendment to be filed to several bills that would prohibit the use of the contingency fee risk multiplier for all motor vehicle insurance lawsuits.
