Florida Senator Ellyn Bogdanoff Files New Strike-All to Personal Injury Protection Bill (SB 1930)

On April 11, 2011, Senator Ellyn Bogdanoff filed a strike-all amendment to Senate Bill 1930 relating to Personal Injury Protection insurance.  Substantially similar to a previous strike-all amendment she filed to the bill on April 5, 2011, but that was not taken up since the bill was not heard, the new amendment cleans up provisions relating to the uses of preferred provider networks, addresses the payment of benefits timing to be the same as that on the date of delivery and adds conditions for limiting reimbursements by an insurer.

The strike-all new amendment also removes section 7 of SB 1930 relating to the implementation of the No-Fault law, removes the inclusion of acupuncturists and removes the requirement for a provider to verbally explain listed services if the insured cannot read.

Additional amendments are expected to be filed to this legislation prior it being considered in the Senate Committee on Banking and Insurance tomorrow, April 12 at 9:15 a.m.
