Florida Senate Releases DHSMV Sunset Review Interim Report

The Florida Senate Committee on Transportation (“Committee”) has released an Interim Report entitled “Agency Sunset Review Update of the Department of Highway Safety and Motor Vehicles” (“Report”).

Under the Florida Government Accountability Act, most state agencies, including the Department of Highway Safety and Motor Vehicles (“DHSMV”) and its advisory committees, are subject to a “sunset” review process to determine whether they should be retained, modified or abolished.

The DHSMV and its advisory committees continuine to be subject to review and may be abolished on June 30, 2009, unless the Florida Legislature passes legislation to provide for its perpetuation.

In its Report, the Committee recommends that the Legislature:

  • Continue the DHSMV
  • Continue the Florida Highway Patrol Advisory Council, DUI Programs Review Board, Medical Advisory Board, and the Automobile Dealer Advisory Board
  • Delete the Bureau of Motor Vehicle Inspection, which is obsolete
  • Consider amending current statutes in order to promote more tax collector participation in providing driver’s license and ID card services
