Florida Office of Insurance Regulation Rule Development Workshop to Consider Statutory, Other Updates to Uniform Mitigation Verification Inspection Form

The Florida Office of Insurance Regulation (“OIR”) will conduct a Rule Development Workshop tomorrow, September 22, 2010 at 9:30 a.m. to review proposed revisions to the Uniform Mitigation Verification Inspection Form (“Form”). The Form, which is among those regulated by Rule 69O-170.0155, F.A.C., is used by inspectors to document policyholder eligibility for wind mitigation-related premium discounts for personal residential property. Time will be allotted for public testimony during the Workshop.
The revisions are necessitated by a 2010 change in Florida law that authorizes only certain licensees to conduct inspections and sign the Form. Additionally, the OIR will consider proposed changes that may need to be made to the Form in order to further clarify the requirements for insurers to award wind mitigation discounts, while ensuring that both inspectors and policyholders are aware of how discounts can be obtained.
Contractors, engineers, architects and other professionals engaged in the business of conducting wind mitigation inspections are also expected to participate. Applied Research Associates, Inc. is scheduled to present on wind mitigation discounts during tomorrow’s Workshop.
While the Form adopted earlier this year was based on information obtained during a series of Rule hearings, the proposed Form being reviewed tomorrow requires the inclusion of photographs, signatures and other items designed to prevent fraud, as well as clearly document mitigation discount eligibility.
