Florida Office of Insurance Regulation Appeals Personal Injury Protection Law Injunction

The Florida Office of Insurance Regulation (“OIR”) advised that it has filed a Notice of Appeal of Non-Final Order and Notice of Automatic Stay today, March 21, 2013 in regard to Leon County Cir. Ct Case No.:  2013-0073-CA: Myers et al. v. McCarty in his Official Capacity. 

The Notice of Appeal is attached for review.

The litigation, which relates to statutory changes made by the enactment of HB 119 relating to Personal Injury Protection insurance, was brought late in 2012 by a group of Florida massage therapists and others in the health care community who are challenging the constitutionality of the new law.

In its announcement today, the OIR noted that the filing of this Notice of Appeal constitutes an automatic stay of yesterday’s circuit court temporary injunction pursuant to Rule 9.310(b)(2), Florida Rules of Appellate Procedure.
