Florida Insurance Consumer Advocate Makes Personal Injury Protection Legislative Recommendations

As a result of an August 2010 comprehensive roundtable-style forum on Florida’s Personal Injury Protection (“PIP”) laws, the Office of the Florida Insurance Consumer Advocate issued a November 3, 2010 report to the Florida Legislature in which it offers recommendations to address concerns with the following PIP-related issues:
- Staged motor vehicle accidents
- Licensure and exemption from licensure of health care clinics
- The insurance claims handling process
- The fee schedule for payments to medical providers
- The questioning of claimants under oath
- The rescission of policies for alleged misrepresentation by the policyholder on the application for motor vehicle insurance coverage
