Florida Insurance Consumer Advocate Makes Personal Injury Protection Legislative Recommendations

As a result of an August 2010 comprehensive roundtable-style forum on Florida’s Personal Injury Protection (“PIP”) laws, the Office of the Florida Insurance Consumer Advocate issued a November 3, 2010 report to the Florida Legislature in which it offers recommendations to address concerns with the following PIP-related issues:

  • Staged motor vehicle accidents
  • Licensure and exemption from licensure of health care clinics
  • The insurance claims handling process
  • The fee schedule for payments to medical providers
  • The questioning of claimants under oath
  • The rescission of policies for alleged misrepresentation by the policyholder on the application for motor vehicle insurance coverage

The report, along with a transmittal letter from Florida Insurance Consumer Advocate R. Terry Butler to Florida Senate President-Designate Mike Haridopolis and House Speaker-Designate Dean Cannon, is attached for review.  Accompanying exhibits are hyperlinked within the report.
