FLORIDA INSURANCE REGULATORY EVENTS

Thursday, May 9

Florida Division of Insurance Agent and Agency Services (“IAAS”) Proposed Rule Hearing; 10:30 a.m. To view the hearing notice, click here. Proposed changes would update the following Rules relating to insurance adjusters and incorporate legislative changes to Part VI of Ch. 626, F.S.:
- Proposed amendments to Rule 69B-220.051, “Conduct of Public Adjusters,” would clarify the responsibilities and requirements of public adjusters and public adjuster apprentices, define the terms “direct supervision” and “adjusting services,” specify the terms and conditions of public adjuster contracts, require the license number on advertisements, delete provisions that reiterate or paraphrase statutory materials and prescribe practices to ensure fair dealing between public adjusters and claimants.
- Proposed changes to Rule 69B-220.201, “Ethical Requirements,” would update the code of ethics for all adjusters, delete provisions that reiterate or paraphrase statutory materials, and clarify the responsibilities and requirements of all adjusters.

Monday, May 13

Florida Office of Insurance Regulation (“OIR”) Public Rate Hearing; 1:00 p.m. American Security Insurance Company has requested an average statewide rate change of 0.0 percent for its property collateral protection program, which is also known as lender-placed insurance. The proposed rates would be effective August 1, 2013 for new and renewal business. The requested change is not uniform, and some areas are subject to higher rates. Florida Hurricane Catastrophe Fund (“FHCF”) Proposed Rule Hearing; 9:00 a.m. Proposed amended Rule 19-8.028 would adopt the 2013-2014 FHCF Reimbursement Premium Formula and 2013-2014 Reimbursement Premium Rates. In addition, it specifies exposure reporting requirements and provisional premiums for specified new participants, revises exemptions from coverage for policies predominantly covering specialized fine arts risks or scheduled personal property meeting specified criteria, and deletes obsolete or unnecessary language.     - Proposed amendments to Rule 69O-149.003, “Rate Filing Procedures,” relating to life and health insurers, delete the Maximum Annual Medical Trend tables from the text of the Rule, provide the URL of the OIR’s Web site on which the tables will be published and updated as needed, and limit the use of streamlined rate increase filings to Medicare Supplement providers with fewer than 1,000 policyholders nationwide, rather than to 1,000 policyholders in Florida.

Proposed amendments to Rule 12B-8.016 will seek to provide clarification on how the retaliatory tax comparison is made among items that “are or would be imposed upon Florida insurers, or upon the agents and representatives of such insurers,” as compared with items from the insurer’s state of domicile that are “directly imposed upon similar insurers, or upon the agents or representatives of such insurers.” Written comments on this issue can be submitted.
