- OIR Proposed Rule Hearing; 9:30 a.m. Proposed amendments to Rule 69O-144.005, “Credit for Reinsurance,” and 69O-144.007, “Credit for Reinsurance From Eligible Reinsurers,” would conform Florida to the National Association of Insurance Commissioners’ Model Law for accreditation purposes and provide consistency among regulatory jurisdictions on how reinsurers are granted the status of “certified reinsurer” (currently termed “eligible reinsurer” in the Rule) and the manner in which Florida domestic insurers can apply credit for reinsurance from these entities. - OIR Rule Development Workshop; 9:30 a.m. Proposed amendments to Rule 69O-166.031, “Mediation of Property Insurance Claims,” would address the invalidity of a portion of the Rule as a result of the ruling in State Farm Florida Ins. Co. v Unlimited Restoration Specialists, Inc., 84 So. 3d 390 (Fla. 5th DCA 2012), as well as eliminate redundant language contained in the DFS Rule governing the Mediation Program. - Florida Department of Financial Services–Division of Workers’ Compensation (“DWC”) Proposed Rule Hearing; 9:00 a.m. The Florida Workers’ Compensation Health Care Provider Reimbursement Manual incorporated in Rule 69L-7.020, and the Florida Workers’ Compensation Reimbursement Manual for Ambulatory Surgical Centers incorporated in Rule 69L-7.100, would be updated to conform to the mandate in paragraph 440.13(12)(b), F.S., limiting workers’ compensation healthcare provider reimbursements to 110 percent of Medicare reimbursement allowances. Manuals containing updated billing codes also would be updated.
- Florida Department of Business and Professional Regulation Proposed Rule Hearing; 10:00 a.m. Rule 61-31.701, “Minimum Standards and Practices for Mold Assessors” and 61-31.702, “Minimum Standards and Practices for Mold Remediators.” Teleconference: (888) 670-3525; participant passcode: 2295006118#.
Wednesday, March 4
- DWC Proposed Rule Hearing; 9:00 a.m.
- Proposed amendments to Rule 69L-6.027 would revise a penalty calculation worksheet to provide the premium credit for the initial payment of premium made to secure coverage against an assessed penalty, as well as adjust the penalty lookback period and multiplier to conform to statutory changes.
- Proposed amendments to Rule 69L-6.028 would change the time frame to impute an employer’s payroll in the absence of business records from 20 to 28 days after receipt of the DFS request to produce records, and would change the factor to calculate employee payroll from 1.5 to 2 times the state average weekly wage, to conform to Section 440.107, Florida Statutes. Also, the time frame for an employer to provide additional records would be revised to 20 business days after the service of the first amended order of penalty assessment.
- Proposed amendments to Rule 69L-6.035 would also change the factor to calculate employee payroll from 1.5 to 2 times the state average weekly wage to conform to Section 440.107. Additionally the amendments would change citations in Rules 69L-6.028 and 69L-6.035 to reflect the current convention of naming to the specific subdivision cited.
