FLORIDA INSURANCE REGULATORY EVENTS
Tuesday, August 26
- Florida Health Insurance Advisory Board meeting; 3:00 p.m. Tallahassee, Florida. Agenda includes updates on state and federal health care issues relating to the Patient Protection and Affordable Care Act (“PPACA”) and development of 2015 legislative recommendations. Presentations will be made on national and Florida outcomes of the PPACA by the National Association of Insurance Commissioners and the Florida Office of Insurance Regulation (“OIR”), respectively.
Wednesday, August 27
- OIR Public Rate Hearing: Florida Citizens Property Insurance Corporation (“Citizens”); 10:00 a.m. Tallahassee, Florida. Citizens has proposed rate changes for its multi-peril and wind-only Coastal Account, Commercial Lines Account and Personal Lines Account. - OIR agenda
- A repeal of Rules 69O-123.001, “Purpose” and 69O-123.002, “Procedure,” relating to the filing of civil remedy notices is proposed because the Florida Department of Financial Services (“DFS”) administers the applicable statutory requirements by Rule 69J-123.002. F.A.C. The OIR does not enforce the provisions of the filing requirements, therefore the Rules are deemed as unnecessary.
- A repeal of Rule Chapter 69O-228 relating to continuing education requirements of insurance representatives is proposed, inasmuch as the OIR does not exercise authority over insurance representatives. Rather, this is the role of the DFS.
- Consideration of proposed amendments to Rule 69O-148.001, which addresses requirements for insurance policies that fund annuities and preneed contracts. Currently, the Rule caps the maximum face amount at $7,500 and the statute caps it at $12,500. The proposed Rule would remove the dollar amount cap and refer instead to the statute, thereby conforming the Rule with current law.

- Florida Division of Insurance Agents and Agency Services Proposed Rule Hearing; 9:30 a.m. Tallahassee, Florida. Proposed changes to Rule 69B-220.051, “Conduct of Public Adjusters,” and Rule 69B-220.201, “Ethical Requirements,” would incorporate legislative changes to Part VI of Chapter 626, F.S. The proposed amendments would clarify the responsiblities and requirements of public adjusters and public adjuster apprentices, define the terms “adjusting services” and “public adjuster apprentice,” specify the terms and conditions of public adjuster contracts, require the license number on advertisements, prescribe practices for fair dealing between public adjusters and claimants, update the code of ethics for all adjusters and delete provisions that reiterate statutory materials.
