Florida Hurricane Catastrophe Fund Rule Development Workshop Report: May 6, 2011

The Florida Hurricane Catastrophe Fund (“FHCF”) held a Rule Development Workshop via teleconference today, May 6, 2011, on proposed Rules 19-8.029 and 19-8.030, Florida Administrative Code, respectively entitled “Insurer Reporting Requirements” and “Insurer Responsibilities.” To view the agenda, click here.
During the brief meeting, FHCF Senior Attorney Tracy Allen explained that the process to amend these Rules in order to adopt the 2011/2012 FHCF Contract Year forms was initiated late last year. Due to a technicality related to a required deadline of that process, the proposed Rules were withdrawn and the process was restarted.
Ms. Allen explained that a request will be submitted to the State Board of Administration (“SBA”) Trustees for approval to file a Notice of Proposed Rule regarding Rules 19-8.029 and 19-8.030 at the May 17, 2011 Cabinet meeting. (Note: A rulemaking hearing will not be held unless specifically requested within 21 days after publication of the Notice. If a hearing is not requested, the proposed Rules can be certified 28 days after publication of the Notice, or 15 days after the SBA Trustees meet, according to Ms. Allen.)
Specifically:
- Proposed Rules 19-8.029 and 19-8.030 would adopt the 2011/2012 FHCF Contract Year forms.
- Rule 19-8.029 adopts the 2011/2012 FHCF Data Call and the 2011/2012 Interim and Proof of Loss forms.
- Rule 19-8.030 adopts the 2011/2012 FHCF Exposure and Loss Examination Advance Preparation Instructions and the 2011/2012 Interim and Proof of Loss forms.
