Dear Governor Crist:
I am writing to request that you place a good cause item on the Financial Services Commission (FSC) agenda for the June 12, 2007, Cabinet meeting.
The Florida Legislature, in its January, 2007, Special Session enacted section 627.711, Florida Statutes to address premium discounts for hurricane loss mitigation. That new statutory section requires the Financial Services Commission to develop by rule a uniform mitigation verification form by July 1, 2007. The Financial Services Commission is adopting a mitigation verification inspection form which insurers must accept as evidence of a home’s mitigation features for use by the insurer in determining if the home is eligible for any premium discounts or credits.Â
This Emergency Rule 69OER07-3 adopts an interim mitigation verification inspection form. This emergency rule is necessary as the temporary mitigation verification form will permit homeowners to utilize the free inspection data already gathered from the My Safe Florida Home Program without delay. The only difference between the form being temporarily adopted by this emergency rule, and the permanent mitigation verification inspection form, is that instead of an inspector’s signature, this temporary form will permit a Department of Financial Services’ certification of inspection data. This will allow DFS to provide homeowners with a mitigation verification inspection form adopted by OIR providing the data obtained and recorded in the My Safe Florida Home Program’s free inspection of the home for the determination of premium discounts or credits.Â
