Emergency Rule Allows DFS to Approve Modified Mitigation Form

The Florida Department of Financial Services (“DFS”), on behalf of the Florida Office of Insurance Regulation (“OIR”) has issued a Notice of Emergency Rule, number 69OER07-3, relating to transition provisions for the use of the Uniform Mitigation and Verification Inspection Form for the “My Safe Florida Home” Program.Â
The effective date of the Emergency Rule is July 1, 2007.
Providing for the temporary use of a modified format of Form OIR-B1-1802 (7/07), the Emergency Rule requires insurers to accept the modified form from the “My Safe Florida Home†Program. The form will allow the DFS to certify the contents of the form as true and correct based on an inspection conducted by a qualified inspector.
Deemed essential as means to permit DFS to expedite home inspection verifications, the Emergency Rule is expected to assist homeowners whose homes have been inspected to more rapidly secure insurance rate relief through the premium discounts and credits set forth pursuant to the “My Safe Florida Home†program.

THE FULL TEXT OF THE EMERGENCY RULE IS:
69OER07-03 Transition Provisions for the Use of the Uniform Mitigation and Verification Inspection Form by the “My Safe Florida Home†Program.
Effective July 1, 2007, insurers shall accept form OIR-B1-1802(7/07) Uniform Mitigation Verification Inspection Form as revised by this Rule. Specifically the form is revised to allow the Department of Financial Services to certify that the contents of the form are true and correct as the result of an inspection conducted by a qualified inspector under Section 215.5586(1), Florida Statutes. Form OIR-B1-1804 “Uniform Mitigation Verification Inspection Form (Emergency)†(7/07) is hereby incorporated herein by reference and is available at www.floir.com.
EFFECTIVE DATE JULY 1, 2007.
