Delaware Department of Insurance Amends Delaware Domestic/Foreign Insurers Bulletin No. 46 pertaining to the Civil Union and Equality Act of 2011 (S.B. 30)

On December 21, 2011, the Delaware Department of Insurance (“DOI”) amended Delaware Domestic/Foreign Insurers Bulletin No. 46 pertaining to the Civil Union and Equality Act of 2011 (S.B. 30).
This amended Bulletin is expected to help clarify the DOI’s expectation of how existing policyholders and potential new policyholders are to be notified and allows time for programming changes to be made. This Bulletin also includes a “sample” generic notification document that can be modified to meet insurers’ respective needs.
Please note that the Department of Insurance will not be promulgating a Regulation at this time, inasmuch as this amended Bulletin and the enacted statute (Title 18, Chapter 2, of the Delaware Code) is believed to provide adequate guidance for compliance.
