Daily Florida Insurance-Related Bills Filed for 2012
HB 833 relating to the Florida Hurricane Catastrophe Fund by State Representative Bill Hager
HB 833 would revise definitions of “retention” and “corporation” relating to the Florida Hurricane Catastrophe Fund (“FHCF”). It also would provide for the calculation of an insurer’s reimbursement premium and retention under the FHCF Reimbursement Contract, as well as revise coverage levels and aggregate coverage limits. The bill would provide for the phase-in of changes to coverage levels and limits, and revise the cash build-up factor included in reimbursement premiums. A phase-in would be provided under HB 833, as well as a reduction of maximum allowable emergency assessments. Also changed would be the name of the Florida Hurricane Catastrophe Fund Finance Corporation. HB 833 would repeal provisions of law related to temporary emergency options for additional FHCF coverage and terminate the Temporary Increase in Coverage Limits (“TICL”) option at the end of the 2011-2012 FHCF Contract Year. Finally, the bill would limits to the 2012-2013 FHCF Contract Year provisions of law relating to TICL options addendum, TICL reimbursement premiums and the FHCF claims-paying capacity. Effective Date: Upon becoming a law
