OIR Rule Workshop
The OIR has issued a Notice of Rulemaking Development regarding the following Rules related to the Cover Florida Health Care Access Program:
- 69O-149.301: Scope
- 69O-149.302: Filing Requirements
- 69O-149.303: Form and Marketing Standards
- 69O-149.304: Rate Standards
- 69O-149.305: Records Maintenance and Reporting
- 69O-149.306: Violations and Penalties
The proposed Rules would implement the Cover Florida Health Care Access Program by establishing filing requirements, standards for forms, marketing materials and the development of rates. They would also provide for the maintenance of specified records and required reporting of information by certain entities. Related violations and penalties are specified. The Rule amendments also would require the electronic filing of an insurer’s report of disposition and other communication related to civil remedy notices.

DFS Rule Hearing
The Florida Department of Financial Services (“DFS”), Division of Consumer Services has issued a Notice of Proposed Rulemaking regarding the following Rule:

The Rule amendments would require the electronic filing of an insurer’s report of disposition and other communication related to civil remedy notices.

OIR Public Rate Hearing
The OIR will hold a public rate hearing regarding a recent rate filing made by Olympus Insurance Company in which a 25.6 percent overall increase for new and renewal homeowners’ insurance policies was requested. The rates would be effective December 18, 2009 for new policies and January 18, 2010 for renewal policies. The requested increases are not uniform and policies in certain geographic areas are subject to higher rate increases than others. To view the hearing Notice, click here.

FCHLPM Windstorm Mitigation Hearing
The Florida Commission on Hurricane Loss Projection (“FCHLPM”) will hold the third in a series of hearings on the implementation of windstorm mitigation discounts, credits, other rate differentials and appropriate reductions in insurance deductibles on Thursday, October 29.
