NAIC Property Risk-Based Capital Working Group Meeting

The National Association of Insurance Commissioners (“NAIC”) Property Risk-Based Capital Working Group of the Financial Condition Committee met on Monday, November 30 at 2:00 p.m. (EST) to discuss a report on Risk-Based Capital and the Current Financial Crisis, as well as receive updates on the Schedule P two-year lines expansion to 10 years in electronic format.

NAIC Suitability of Annuity Sales Working Group Meeting

The NAIC Suitability of Annuity Sales Working Group of the Life Insurance and Annuities Committee will meet on Tuesday, December 1 at 4:00 p.m. (EST) to discuss proposed revisions to the Suitability in Annuity Transactions Model Regulation.  The registration call-in number is:  412.317.6715.

DFS Rule Workshop

The Florida Department of Financial Services (“DFS”), Division of Workers’ Compensation has issued a Notice of Rulemaking Development regarding the following proposed Rules that would require workers’ compensation carriers to report all instances of health care provider over-utilization, as well as improper billing and billing errors:

The proposed Rules would also:

  1. Clarify that workers’ compensation carriers may fulfill their mandatory reporting requirements by filing the medical claims data elements required in Rule 69L-7.602, F.A.C.; and
  2. Provide a method by which carriers may report other health care provider violations, such as failure to submit medical records and reports, failure to refund an overpayment of reimbursement, collecting payment from an injured employee or failure to follow standards of care.

If a Rule Development Workshop is requested in writing and not deemed unnecessary by the agency head, one will be held at the date, time, and place shown below:

DFS Rule Hearing

The DFS, Division of Workers’ Compensation has issued a Notice of Proposed Rule regarding the following Rule:

  • 69L-7.501: Florida Workers’ Compensation Reimbursement Manual for Hospitals (“Reimbursement Manual”)

The proposed Rule amendments would use Medicare’s Hospital Outpatient Prospective Payment System to reimburse hospitals for outpatient bills.  Payment adjustment factors of 1.74 times the Medicare allowed amount for scheduled surgeries and 3.95 times the Medicare amount for other specified compensable charges would be applied. Additional changes to the Reimbursement Manual would include recognition of the Integrated Outpatient Code Editor, National Correct Coding Initiative edits and updates from the Centers for Medicare and Medicaid Services in the Medicare Hospital Outpatient Prospective Payment System.  Technical formatting changes to the Reimbursement Manual also would be made.

Workers’ Compensation Advisory Board Formative Hearing

Florida Commission on Hurricane Loss Projection Methodology Meeting

The Florida Commission on Hurricane Loss Projection Methodology (“Commission”) will meet on Friday, December 4 from Noon through 2:00 p.m. in the Hermitage Conference Room, Hermitage Centre, 1801 Hermitage Boulevard, Tallahassee.  The call-in number for this meeting is:  888.808.6959; conference code:  4765251363.

Florida Commission on Hurricane Loss Projection Methodology Windstorm Committee Meeting

The Florida Commission on Hurricane Loss Projection Methodology Windstorm Mitigation Committee (“Committee”) will meet on Friday, December 8 from 9:00 a.m. through 4:00 p.m. in the Hermitage Centre Conference Room, Hermitage Centre, 1801 Hermitage Boulevard, Tallahassee.  The call-in number for this meeting is:  888.808.6959; conference code:  4765251363.

The purpose of the meeting is to discuss the Committee’s draft report on recommendations for improving the process of assessing, determining and applying windstorm mitigation discounts, credits, rate differentials and other appropriate reductions in insurance deductibles.  The Committee is required to present its report to Florida Executive and Legislative leadership by February 1, 2010.

OIR Rule Hearing

The Florida Financial Services Commission, Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rule regarding the following insurance premium discount for hurricane loss mitigation Rule:

The proposed Rule amendments would adopt revised versions of Form OIR-B1-1655, entitled “Notice of Premium Discounts for Hurricane Loss Mitigation” and Form OIR-B1-1802, entitled “Uniform Mitigation Verification Inspection Form.”

Both Forms are being revised based on changes that have been made to the My Safe Florida Home program and experiences of the OIR, insurers and policyholders.

  • Form OIR-B1-1655 is being revised to remove references to the free inspections and grants offered by the My Safe Florida Home program, since the inspections and grants are no longer available.
  • Form OIR-B1-1802 is being revised to use terminology commonly used in the construction industry in describing the construction features to be inspected, as well as to require verification that the inspector actually conducted the inspection.
