DFS/Division of Risk Management Rule Development
The Florida Department of Financial Services (“DFS”), Division of Risk Management (“DRM”) has issued a Notice of Rulemaking Development regarding the following Rule:
- 69H-2.008: Other Forms Adopted
The purpose of the proposed Rule is to develop forms for requesting information from workers’ compensation claimants and liability claimants in order to comply with Section 111 of the Medicare, Medicaid, and State Children’s Health Insurance Program (“SCHIP”) Extension Act of 2007, which became effective on July 1, 2009. The proposed Rule would add mandatory reporting requirements with respect to Medicare beneficiaries who receive settlements, judgments, awards, or other payments from liability insurance (including self-insurance), no-fault insurance, or workers’ compensation.
The DRM must identify any Medicare beneficiaries who have existing claims with the DRM and collect certain data that will be reported to the Center for Medicare and Medicaid Services (“CMS”). The data collected under federal law will be used by CMS in processing claims billed to Medicare for reimbursement of items and services furnished to Medicare beneficiaries and for Medicare as a Secondary Payer recovery effort, as appropriate.

OIR Rule Hearing
The Florida Office of Insurance Regulation (“OIR”) has issued a Notice of Proposed Rule regarding proposed amendments to Rules contained in Chapter 69O-156 relating to Medicare Supplement Insurance.
The proposed Rules allow for new product generation by adopting revisions made on September 24, 2008 to a NAIC Model Regulation that implements the NAIC Medicare Supplement Insurance Minimum Standards Model Act. The revisions include major changes to Medicare Supplement plans, along with benefits first approved by the NAIC in March 2007 and subsequently authorized by the Medicare Improvements for Patients and Providers Act of 2008 (“MIPPA”). Changes required by the Genetic Information Nondiscrimination Act of 2008 (“GINA”) also were adopted.

DFS/Division of Workers’ Compensation Rule Development
The Florida DFS, Division of Workers’ Compensation has issued a Notice of Rulemaking Development regarding the following Rule:
- 69L-6.012: Notice of Election to be Exempt
The proposed Rule amendment would delete and replace all language in subsection 69L-6.012(15), F.A.C., and add a new paragraph 69L-6.012(15)(a), F.A.C. The proposed new language would provide that when a corporation or limited liability company named on any Certificate of Election to be Exempt (“Certificate”) remains dissolved or inactive after 90 days, the Certificate is immediately revoked. Additional language also provides that when a person named on a Certificate no longer meets the issuance requirements of the Certificate, that Certificate is revoked. The new paragraph would provide guidance regarding a corporation or limited liability company’s right to petition for a review of a revocation, or to file an appeal. The proposed Rule amendment also advances the statutory mandate to facilitate the self-execution of workers’ compensation law pursuant to Chapter 440 F.S.

OIR Rule Hearing
The Florida OIR has issued a Notice of Proposed Rule regarding the following Rule:
- 69O-189.003: Workers’ Compensation: Application and Audit Procedures
The Florida Financial Services Commission is required by law to issue public notices regarding workers’ compensation coverage application, payroll audit and worker classification Rules. In 2008, the National Council on Compensation Insurance (“NCCI”) filed a proposal for a Rule addressing these matters with the OIR.
The proposed Rule, based on the NCCI proposal, would allow electronic signatures in the application for workers’ compensation coverage and in the annual audit, so long as the electronic signature process complies with Florida’s Uniform Electronic Transaction Act. While the current Rule incorporates certain NCCI publications by reference, the proposed Rule explicitly provides certain audit procedures.
The proposed Rule also would raise the threshold for an on-site audit from $5,000 to $10,000. Any audit for under $10,000 would be handled by mail to save costs for both the employer and insurance carrier.
